		[LICENSE GRANT] TradiMed PTE LTD. ("Licensor") grants to you a non-exclusive, non-transferable license to use the TradiMed Internet Software (the "Internet Software") from a single personal computer at any time. This is a single individual user license. Only you, the registered user, may access and use the Internet Software under this license. Additional licenses must be purchased from Licensor in order to have multiple-user authorized access. Installation or use of the Internet Software at a university, healthcare facility, institution or organization, for use other than your personal use, is strictly prohibited under this license. If it is the case that such an organization wants to license for group use, please contact at master@bioherb.com. You may not permit other individuals to access the Internet Software using your personal username and password. You may not sublicense the Internet Software or otherwise allow others to use the Internet Software licensed to you. The contents of the Internet Software, including text, graphics, images and other material ("Content"), are protected by copyright under law, and title to the Content shall not pass to you or any other user. Unauthorized use of the Content may violate copyright, trademark, and other laws. Except as described below, none of the Content or the Internet Software may be reverse-engineered, disassembled, decompiled, reproduced, transcribed, downloaded, stored in a retrieval system, translated into any language or computer language, re-transmitted in any form or by any means (electronic, mechanical, photoreproduction, recordation or otherwise), resold or redistributed. You are allowed to print individual pages or screens from the Internet Software using your browser's Print commands for noncommercial, one-time use. You may not download individual images or text items for local storage and distribution. Content is subject to change without notice at the editorial discretion of Licensor. If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates. [INTERNET SOFTWARE] Licensor reserves the right at any time to alter prices, features, capabilities, functions, licensing terms, release dates, general availability or any other characteristics of the Internet Software as it sees fit, and you acknowledge that your continued use of the Internet Software thereafter constitutes your acceptance of any such changes. [TITLE] Titles, ownership rights, and intellectual property rights in and to the Internet Software shall at all times remain with Licensor. You acknowledge that you shall only have a limited license to use the Internet Software for as long as this Agreement is in effect. The Internet Software is protected by the copyright laws of the international copyright and trade treaties. [LIMITED WARRANTY] Except as expressly provided herein there are no warranties, conditions or representations, express or implied by statute, usage, custom of the trade or otherwise with respect to the internet software licensed hereunder, and licensor expressly disclaims any such warranties, including but not limited to, warranties or representations of merchantability, suitability or fitness for a particular purpose, durability and noninfringement of third party rights. Without limiting the generality of the foregoing, licensor does not warrant that the internet software will meet all of your needs or that operation of the interent software will be error-free, and no representations or warranties are made about the accuracy, reliability, completeness or currentness of the contents of the internet software. The contents of the internet software are not intended in any way to constitute medical advice or to be relied upon for medical diagnosis or treatment; a licensed medical doctor should always be consulted for medical advice. This limited warranty constitutes an essential part of this agreement. If you do not accept the terms of this limited warranty and agree to be bound hereby, you should exit this site immediately and discontinue the subscription process. [CUSTOMER REMEDY] Licensor and its suppliers' entire liability for any damages you may incur and your exclusive remedy shall be, at Licensor's option to either (a) refund the Internet Software license purchase price in effect at the time of purchase, or (b) repair or replace the Internet Software that does not meet Licensor's limited warranty. This limited warranty is void if failure of the Internet Software has resulted from accident, abuse, or misapplication. [LIMITATION OF LIABILITY] Under no circumstances and under no legal theory, whether in tort, contract or otherwise, shall licensor or any other person be liable for any direct, indirect, special, incidental, exemplary, punitive or consequential damages of any character, including, without limitation, damages for personal injury, property damage, loss or interruption of business or goodwill, work stoppage, computer or other system failure or malfunction, or any and all other personal or commercial damages or losses, even if licensor or any other person has been advised of the possibility of such damages. In no event will licensor or any other person be liable for any damages whatsoever in excess of the amount paid for the internet software unit that is the subject matter of the claim or that is directly related to the cause of action. Some jurisdictions do not allow the exclusion of implied warranties or the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from jurisdiction to jurisdiction. [TERM] This Agreement shall become effective upon your completion of this order for the Internet Software and shall remain in effect for a period of the contract (the "Term"). Licensor may terminate this Agreement immediately at any time if you fail to comply with any term or condition of this Agreement, and in such event you shall forfeit the balance of your subscription price. [COUPON] The "Coupon" is used as a means of payment only in TradiMed for its services and products, if any applicable. Individual members can charge its value whenever members need to use the TradiMed services. Each unit is by US$10, and the amount is the multiples of an unit. Group members are exempted from coupons, since they are accessing the TradiMed services through Site Licensing which does not require log-in nor coupons. Redemption can be made, if members cannot find any valuable services (excepting extraordinary problems such as natural disasters and/or hacking by the 3rd party) at TradiMed ONLY during the first ten working days. After ten working days, the coupon balance cannot be refunded to members. Please advise it and purchase as you need. If any discrepancy of recharging, please contact us, master@bioherb.com, to correct the balance. At the membership withdrawal, the balance of Coupn is NOT refunded after ten working days, and the amount is donated under the name of the member. [MISCELLANEOUS] If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and shall not affect the validity of the remaining portions of this Agreement. This Agreement constitutes the entire agreement between you and Licensor and supersedes any prior agreement or understanding, whether written or oral, relating to the Internet Software. You shall comply with all export regulations pertaining to the Internet Software in effect from time to time. In particular, without limiting the generality of the foregoing. You hereby warrant that you will not directly or indirectly export, re-export or trans-ship the Internet Software in violation of or otherwise in contravention of applicable export laws, rules and regulations. 		[ Private Policy ] The following information makes up our Privacy Policy, and describes how we manage information regarding your use of the TradiMed websites (the "Site"). Please read the following policy to understand how your Personal Information will be treated as you make full use of our Site. This policy may change from time to time; consequently, you should review this Privacy Policy each time you log into our Site. TradiMed's primary goal in collecting Personal Information is to provide you with a customized experience within the Site. For example, storage of your personal bookmarks and establishment of your identity within the Message Boards are dependent upon our knowledge of your identity. TradiMed does research on our users' demographics, interests, and behavior based on the information provided to us upon registration, during a promotion, from our server log files or from surveys. We do this to better understand and serve our users. This research is compiled and analyzed on an aggregated basis. TradiMed may share this aggregated data with customers or business partners. TradiMed may sometimes permit third parties to offer subscription and/or registration-based services through the Site. In these instances, TradiMed is not responsible for any actions or policies of such third parties. You should check the applicable privacy policy of such party before providing personally identifiable information. It is not possible for a user to delete his or her profile from our database, nor is it feasible to delete all traces of a user's activity in the system. Please remember that any information (including personal and medical information) that you reveal in a public forum (such as a bulletin board, mail list, chat room/event) is not subject to this Privacy Policy and will be seen by third parties not related to TradiMed and may be used by them to contact you or for unauthorized purposes. Also, if you link to a third party site from TradiMed, any information you reveal on that site is not subject to this Privacy Policy. Consequently, you should carefully review the privacy policies of each site you visit. We collect customer registration information. The information we collect includes: o Registration o Member Information o Password o Full Name o Email Address TradiMed may change this Privacy Policy at any time by posting revisions to our Site. Your use of the site constitutes acceptance of the provisions of this Privacy Policy and your continued usage after such changes are posted constitutes acceptance of each revised Privacy Policy.
